Definition

An under-construction building is a structure that has its foundations and external walls built up to at least one meter in height – which indicates the first above-ground floor. It is sufficient for the complete external wall to be constructed; internal partitions are not required.

Use and Registration of an Unfinished Building

For the purposes of registration in the real estate cadastre, an under-construction building is considered a structure for which no occupancy permit has been issued, no registration number has been assigned, and it has reached such a stage of construction that the technical and functional layout of its first above-ground floor is evident from the submitted expert appraisal.

What is required to register an under-construction building?

To register the rights to an under-construction apartment or non-residential unit, the following must be submitted: a construction contract along with a geometric plan, a contract for the construction or extension of the building, and an expert appraisal of the stage of completion. The owner listed in the contract is recorded as the registered owner.
